Anti-Spam Policy

Introduction

This Anti-Spam Policy (the “Policy”) is an integral part of the License Agreement (the “Agreement”) between the owner of the Target Direct service (the “Licensor”) and the user of Target Direct (the “Licensee”).

By registering for and/or using the Service, the Licensee fully and unconditionally accepts this Policy.

The Licensor may amend the Policy unilaterally. The current version is always at https://targetd.ru/legal/antispam-policy. Continued use after changes means acceptance.

1. Terms

1.1. License Agreement — the agreement governing use of the Service.

1.2. Service — the Target Direct platform for targeted official B2B email to Russian legal entities: company-catalog segments, letter and PDF personalization, sending via the Licensee’s SMTP mailboxes, exclusions, and reporting.

1.3. Licensor — the owner of the Target Direct service, granting rights to use the Service.

1.4. Licensee — a natural or legal person using the Service under the Agreement.

1.5. Licensee contact base — addresses and related data used for mailing via the Service, including selections from the Service catalog and/or data imported by the Licensee.

1.6. Email — a message sent by the Licensee using the Service.

1.7. Targeted official mailing — personalized B2B business communication to legal entities or sole proprietors for legitimate business purposes, in compliance with law and ethics.

1.8. SPAM — untargeted mass mail; misleading sender or content; forged return addresses or domains; mail without a working unsubscribe; mail violating Russian law (including the Advertising Law) or ethics; mail causing high complaints, bounces, or blacklist listings.

1.9. Spam complaint — recipient/FBL complaint; IP/domain blocks; breach of Quality Metrics.

1.10. Quality Metrics: Bounce Rate ≤ 25%; Complaint Rate ≤ 1%. The Licensor may adjust thresholds with notice.

2. Principles

2.1. The Policy supports lawful, ethical, effective B2B outreach—not spam.

2.2. The Licensee must not harm the Licensor’s reputation or cause IP/domain blocks.

2.3. Personalized, relevant B2B offers to corporate addresses from lawful sources are supported when this Policy and Russian law are followed.

2.4. Quality and relevance over volume.

3. Prohibited use

3.1. Spam as defined in 1.8 is prohibited.

3.1.2. Prohibited content includes offensive, harmful, fraudulent, obscene, discriminatory, threatening, or defamatory material; illegal gambling/pyramid/drug/weapon schemes; malware; IP infringement; sender impersonation; claiming the mailing is from Target Direct or the Licensor (except Service notices).

3.1.3. Purchased/rented lists of doubtful origin or relevance are prohibited.

3.1.4–3.1.7. Unauthorized From addresses, header forgery, missing unsubscribe, and mail unrelated to the recipient’s professional role are prohibited.

3.1.8. The Service may not be used for unlawful advertising, including breaches of Federal Law No. 38-FZ of 13.03.2006 “On Advertising”, in particular Article 18 (advertising distributed without the recipient’s prior consent).

3.1.9. Contact bases obtained unlawfully or from scraped sources are prohibited unless the Licensee can document the lawful source and a processing ground for each address.

3.1.10. Circumventing exclusion and suppression lists is prohibited, including re-mailing recipients who have unsubscribed, refused, or are listed on the Licensee’s or Licensor’s do-not-contact list.

3.1.11. Sending mail that hides the actual sender—using another party’s name, return address, or domain without lawful access and rights (spoofing)—is prohibited.

3.1.12. Mass automated advertising mailings are prohibited without a compliance mode enabled (ground verification, working unsubscribe, suppression-list maintenance, and logging). The platform does not provide its own SMTP for advertising: sending is carried out only through mailboxes lawfully connected by the Licensee.

4. Quality requirements

4.1. The Licensee is fully responsible for contact bases and message content.

4.2. Aim for relevance, personalization, data freshness, clear sender identity, and professional value.

4.3. Keep Quality Metrics within the limits in 1.10.

5. Monitoring

5.1–5.5. The Licensor may monitor mailings, analyze complaints and metrics, verify registration data, provide guidance, and temporarily suspend sending for investigation.

6. Consequences

6.1. For violations, mass complaints, or poor metrics, the Licensor may warn, restrict sending, or terminate the Agreement and block the account without refund.

6.2. Immediate suspension is allowed if the Service, reputation, or compliance with providers/authorities is at risk.

6.3. The Licensee remains liable for legal breaches and must indemnify the Licensor.

6.4. Upon justified abuse complaints, breach of the Quality Metrics (clause 1.10), or demands from public authorities, the Licensor may immediately suspend the specific campaign and/or the Licensee’s account until the cause is remedied and the Licensee confirms compliance with this Policy.

7. Final provisions

7.1. The Policy is part of the Agreement; otherwise Russian law and the Agreement apply.

7.2. Ethical B2B outreach standards are expected.
